“We separated, but we were prepared …”

To this day, Emily and James are good friends, despite separating not long after they’d moved to Jerez together. 

They’d been here several times over the years and had decided to settle, in their own place, so they got in touch with Home Hunter Jerez. The plan had been clear: to buy the property jointly. James would take on the full cost of the renovation, and Emily, for her part, had already made the tough decision to leave behind her successful career in Santa Barbara.

Without a prior agreement drafted by a specialist lawyer, serious conflicts can arise – such as which law should apply or which courts have jurisdiction over their assets in Spain. Likewise, someone who contributes more money, or who pays a mortgage or expenses on a property not in their name, may find themselves completely unprotected and could lose their investment.

In addition, both made a will in Spain so they would be protected in the event that one of them passed away.

Thanks to these agreements – which must be clearly drafted by a specialist lawyer – Emily and James had a peaceful separation and today maintain a good friendship. They were clear about the rules of the game. James recovered the investment he made in the renovation, and Emily was compensated for the damages resulting from giving up her professional career back in the US. In this way, they avoided costly and painful legal disputes.
